1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Hareful website (the "Site") and any purchases you make through it. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully before using the Site or making a purchase.

If you do not agree to these Terms, please do not use the Site.

We may update these Terms from time to time. The version in effect on the date you place your order is the version that applies to that order. Continued use of the Site after changes have been posted constitutes your acceptance of the revised Terms.

3. Eligibility

To purchase from the Site, you must be at least 18 years of age and legally capable of entering into a binding contract. By placing an order, you represent and warrant that you meet these requirements.

If you are accessing the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

Some features of the Site may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@hareful.com if you suspect unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent or harmful.

5. Products

We aim to describe our products as accurately as possible. Product images, colors, sizes, and descriptions are provided for illustration purposes. Minor variations may occur, particularly due to differences in screen color reproduction, manufacturing batches, and natural product variation.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or change product specifications at any time without notice.

6. Pricing and Payment

All prices on the Site are listed in United States Dollars (USD) unless otherwise stated. Prices do not include applicable sales tax, which will be calculated and added at checkout based on your shipping address.

Shipping costs are calculated and displayed at checkout before you complete your order.

We accept payment by major credit and debit cards, and other methods displayed at checkout. Payment is processed at the time the order is placed. All payment processing is handled by third-party providers Shopify Payments or Stripe and is subject to their terms and security standards. We do not store your full payment card details on our servers.

We reserve the right to refuse, cancel, or limit any order at our discretion, including for reasons such as product unavailability, suspected fraud, errors in pricing or product information, or violation of these Terms.

In the event of a pricing error, we will contact you before processing the order and give you the option to proceed at the corrected price or cancel.

7. Order Acceptance

When you submit an order through the Site, you are making an offer to purchase the products in your cart at the listed price. We may accept or reject your offer at our discretion.

Your order is accepted only when we send you a confirmation email confirming that the order has been processed. Until that confirmation is sent, no binding contract exists between us. The automated order receipt sent immediately after checkout is not an order confirmation.

8. Shipping and Delivery

We ship to addresses within the United States and to selected international destinations as displayed at checkout.

Estimated delivery times are provided at checkout and in your order confirmation. These are estimates, not guarantees. Actual delivery times may vary due to carrier delays, weather, customs processing (for international shipments), or other circumstances beyond our reasonable control.

Risk of loss and title to the products pass to you upon delivery to the shipping address you provided.

If you provide an incorrect shipping address, we are not responsible for non-delivery or for the cost of re-shipping. We may charge additional shipping fees to redirect or re-deliver orders.

9. Returns and Refunds

Our returns process is governed by our Returns Policy, available at https://hareful.com/pages/help-centre. The Returns Policy is incorporated into these Terms by reference.

We offer a 30-Day Keep-Running Guarantee that goes beyond a standard return policy. Full details, including how to initiate a return and any conditions that apply, are set out in the Returns Policy.

Refunds, when granted, are issued to the original payment method within a reasonable time after we receive the returned goods.

10. Product Use and Health Disclaimer

Hareful products are athletic apparel designed to support runners during training and recovery. They are not medical devices. They are not intended to diagnose, treat, cure, or prevent any medical condition.

If you have any health condition that may affect your circulation — including but not limited to diabetes, deep vein thrombosis, peripheral artery disease, varicose veins, lymphatic disorders, or any skin condition affecting the legs — please consult a qualified healthcare professional before using compression products.

Discontinue use and seek medical advice if you experience numbness, tingling, pain, skin discoloration, swelling, or any other unusual symptom while using our products.

You use our products at your own risk. We are not liable for any injury, condition, or adverse outcome arising from misuse, pre-existing medical conditions, use against medical advice, or use of the product for purposes other than its intended use.

11. Intellectual Property

All content on the Site — including but not limited to the Hareful brand name, logo, product designs, photographs, text, graphics, audio, video, and software — is the property of Zenith Grove LLC or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content on the Site without our prior written permission.

You may view, download, and print content from the Site for your personal, non-commercial use only.

The name "Hareful" and any associated logos, slogans, and trade dress are trademarks of Zenith Grove LLC. Use of these marks without our express written permission is prohibited.

12. User Content

If you submit reviews, comments, photos, or any other content to the Site or our social media channels ("User Content"), you grant Zenith Grove LLC a worldwide, perpetual, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with our business.

You represent and warrant that:

• The User Content is original to you and does not infringe any third-party rights
• You have the right to grant the license above
• The User Content does not contain false, misleading, defamatory, obscene, or unlawful material

We reserve the right to remove any User Content at our discretion.

13. Prohibited Uses

You agree not to use the Site:

• For any unlawful purpose or to solicit unlawful acts
• To violate any applicable federal, state, or local laws or regulations
• To infringe upon the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, or discriminate against any person
• To submit false or misleading information
• To upload or transmit viruses, malware, or any malicious code
• To interfere with or circumvent the security features of the Site
• To scrape, harvest, or collect data from the Site by automated means
• To impersonate any person or entity, or to misrepresent your affiliation with any person or entity

We reserve the right to terminate your access to the Site for violation of any of the above.

14. Disclaimer of Warranties

The Site and the products sold on it are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, except as required by applicable law.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the extent permitted by law, and any warranties that cannot be excluded under applicable law will be limited in duration to the minimum period permitted by law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Zenith Grove LLC, its members, managers, officers, employees, affiliates, agents, contractors, or licensors be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for lost profits, lost data, lost training time, lost race entries, personal injury (except where required by law), or any other loss arising out of or in connection with:

• Your use of, or inability to use, the Site or the products
• Errors, mistakes, or inaccuracies in content
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Site

Our total cumulative liability to you for any claim arising from your purchase or use of the Site is limited to the amount you paid us for the product giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zenith Grove LLC, its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your violation of these Terms
• Your use of the Site or the products in a manner not authorized by these Terms
• Your violation of any applicable law or third-party right
• Any User Content you submit

17. Privacy

Your use of the Site is also governed by our Privacy Policy, available at https://hareful.com/policies/privacy-policy. By using the Site or placing an order, you acknowledge and agree to the data practices described in the Privacy Policy.

18. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by us. We are not responsible for the content, privacy practices, or actions of any third-party site or service. We provide these links for convenience only. Accessing them is at your own risk.

19. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms when the failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, pandemic, government action, labor disputes, supply chain disruption, internet or telecommunications outages, or other force majeure events.

20. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

21. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Zenith Grove LLC.

22. Entire Agreement

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Zenith Grove LLC regarding the use of the Site and supersede all prior agreements, communications, and understandings, whether written or oral.

23. Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict-of-law principles.

You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you hereby consent to the personal jurisdiction and venue of those courts.

24. Dispute Resolution

Before initiating any legal action, you agree to first contact us at support@hareful.com to attempt to resolve the dispute informally. We will use good-faith efforts to resolve any dispute through direct negotiation.

If we cannot resolve the dispute informally within sixty (60) days, either party may initiate formal legal action in accordance with Section 23.
